What is the 1099-MISC Form?

1099-MISC is a tax form used to report miscellaneous payments that cannot be reported on other 1099s such as 1099-NEC, 1099-INT, and 1099-DIV. It is filed for payments made in the course of trade or business. Typically Filed for:

  • Rent payments: For office space, land, or machine rental (individual tenants are excluded)
  • Royalties: For patents, copyrights, or natural resources.  
  • Prizes and awards
  • Medical and Healthcare: Payments made to health care providers in specific cases.
  • Attorney Fee: Specifically for legal settlements (excluding legal services).
  • Other Income: Income from fishing boat proceeds, crop insurance, and income not reported elsewhere.

Are you required to file a 1099-MISC?

As a business, you are required to file 1099-MISC if paid:

  • At least $10 in royalties.
  • At least $600 for rent, prizes, or other miscellaneous income types.
  • Gross proceeds of at least $600 to an attorney.

Payments made for miscellaneous services above $600 require a 1099-MISC. It can be the payment for a service or the sum of services paid. The sum must be above $600, though!

To file 1099-MISC, you must have:

  • Payee information, including name and TIN
  • Payer details (Name, tax ID, or SSN)
  • Payment details
  • Any tax withholding in case of a foreign payee (optional)

The IRS requires you to file 1099-MISC at the end of the year. As a business entity, you must keep these deadlines in mind:

  • Recipient Copy: Friday, January 31, 2025
  • The eFile of the IRS: Monday, March 31, 2025
  • Paper Filing of the IRS: Friday, February 28, 2025

  • Log in to your account or sign up if you don’t have an account with us.
  • Next, open the dashboard and select a new filing from the left menu.
  • Here, you will need to choose the year of filing and form type. In the current scenario, you should go for a 1099-MISC filing.
  • A form will show up with all the necessary fields. 
  • Add all information, including payer and payee details. 
  • Once done, you can submit copy A to the IRS and copy B to the payee.

    If you are an individual, it’s not required to file a 1099-MISC for rent paid to the landlord. These payments are usually reported on the landlord’s rental income tax report. Tenants aren’t required to file any forms with the IRS. However, some exceptions still remain.
